SEPARATION COLORADO Legal Separation in Colorado is not the same as physical separation of the parties. It is a legal Decree that declares that the parties are now legally separate and no longer responsible for the actions of each other involving property and assets. The parties no longer bind one another in legal commitments. If one spouse needs to stay on the other spouse’s health insurance, or if the parties have religious reasons to not get divorced, legal separation may be an answer. Legal Separation can also provide time to consider reconciliation. With legal separation the parties are not free to remarry. The process of obtaining a Decree of Legal Separation is identical to the divorce process and either party may convert a Decree of Legal Separation into a Decree of Dissolution of marriage after 6 months. If the parties reconcile prior to the conversion, the case may be dismissed and the parties remain married.
