FAMILY LAW DENVER Nicholas Family Law provides full Family Law, Divorce, Divorce Mediation, and Child Custody services for the Denver Colorado metro area. Below are the legal categories we provide legal services for our clients. Practice Areas Divorce is called a Dissolution of Marriage in Colorado. A Person must reside in Colorado for 90 days prior to filing an action and the final Decree of Dissolution from the court cannot be given until at least 90 days have passed since the court got jurisdiction over the parties. Child Custody is called Parental Responsibility in Colorado. It consists of parenting time, which is the amount of time each parent will have with the children as well as decision-making. Parenting time is known as visitation in other states. Decision-making consists of one or both parents being designated to make important decisions about the children. Child Support is an amount calculated by a worksheet that considers the amount of time each parent has with the children; the incomes of both parents, and the amounts each parent must pay for the children for needs such as health insurance and daycare. Alimony is called Maintenance in Colorado. On a temporary basis it can be calculated by a formula, but on a permanent basis it is calculated using several factors in law. It is used to allow one spouse to get enough education or training to be able to reenter the work force at a living level. It can also be used to level the incomes of the parties and balance the property division. Maintenance has two parts. (1) the ability of one person to pay it while meeting his or her own needs; and (2) the needs of the receiving person considering the overall division in the Dissolution. Property Division is ordered on an equitable basis. It is not 50/50 but is a division that is considered fair by the court. It can vary, depending upon the needs of each person and the amount of maintenance that is ordered. Preservation of Assets is possible in Colorado. Neither side must use all the assets to maintain themselves and each can keep many assets for themselves. Marital assets are those acquired during the marriage, including the increase in value of non-marital assets. The marital assets are the only ones that are divided by the court. Annulment means that the marriage never existed and no divorce is needed. Annulments are discouraged when children are involved and annulments usually require specific findings by the court that the marriage did not legally take place. A marriage can be annulled under limited circumstances in Colorado. Criminal / Domestic Violence. Many parties to a divorce proceeding find themselves in other courts dealing with protection orders, criminal charges or even contempt charges in the divorce proceeding. Such matters are criminal in nature and cannot be handled lightly. They can go on a person's permanent record and affect every aspect of the person's life. There are many ways to handle these matters, so everyone can feel safe and no one has permanent problems as a result. Child Relocation is a complicated matter in Colorado. Any parent may move where they choose to, but the court must decide whether the parent may take the children with them. The court looks at the interests of the children, while keeping in mind the disruption to the parent who is not moving.
